SB 1255

Date Of Separation

On July 25, 2016, Governor Brown signed SB 1255. SB1255 adds sections 70 to the California Family Code and overturns a controversial decision by the California Supreme Court holding in In Re Marriage of Davis (2013) 220 Cal.App.4th 1109, that established the date of legal separation as the date that the parties lived in separate residences. SB 1255 becomes effective on January 1, 2017.
